BasePlate Terms of Use

These terms cover your use of the BasePlate iOS and watchOS app, published by H3LX Labs LLC. Installing or using the app means you accept them.

Your licence

We grant you a personal, non-exclusive, non-transferable licence to use BasePlate on devices you own or control, consistent with the Apple Media Services Terms and the standard Apple End User Licence Agreement.

Your account

BasePlate creates an account for you automatically on first launch so the app works immediately. You can sign in with Apple or Google at any time to attach a way back into that account — which is what lets your work reach a new phone.

Until you sign in, that phone is the only key to your account. Your work is backed up on our servers, but if the app is deleted there is no way for us to identify you and give it back. We are not able to recover an unclaimed account, and we will not attempt to guess which one was yours.

You are responsible for what happens under your account. Do not share your sign-in credentials.

Your content

Timelines, shot lists, reference frames, camera settings, notes and contacts you enter are yours. We claim no ownership of any of it.

You grant us only the permission we need to run the service: to store your content, to sync it between your devices, and — when you choose to share a day — to publish the part of it you shared to the link you generated. That permission ends when you delete the content or your account.

Sharing

When you share a wedding, anyone holding that link can see the schedule you shared. The link is long and unguessable, but it is not password-protected. You choose who to send it to and you can revoke it at any time; someone who already opened it may still hold their own copy.

Your private layer — your shot list, your frames, your settings — is never included.

Images you save

BasePlate lets you keep reference frames and pose prompts in a private library. Most photographers build these from work they admire, and that is what the feature is for.

You are responsible for having the right to use what you upload. Saving an image you did not make, as private reference, is ordinarily fine — it is the same thing as a pinboard or a folder on your desktop. Reproducing someone else’s photograph, or passing it off as your own work, is not, and nothing in BasePlate makes it so.

Your library is private. It is not published, not shown to other people, and does not travel on a timeline you share — reference frames stay in your own layer, which is yours alone.

If you believe something stored in BasePlate infringes your copyright, write to support@h3lxlabs.com with enough detail to identify the work and where it appears. We will look into it and remove infringing material, and we may close accounts that repeatedly infringe. We are a service provider under the Digital Millennium Copyright Act and act on notices we receive; that address is our contact for them.

Subscriptions

BasePlate is free to use, and free forever for receiving a day somebody shared with you. BasePlate Pro is an auto-renewing subscription:

• $79 per year, or $9.99 per month, charged to your Apple ID at confirmation of purchase.
• It renews automatically at the same price unless you turn off auto-renew at least 24 hours before the current period ends.
• Your account is charged for renewal within 24 hours of the end of the current period.
• Manage or cancel it in your Apple ID settings, not here — we cannot cancel it for you.
• Prices may change; we will tell you before a change affects you, and Apple will ask you to agree to any increase.

Refunds are handled by Apple under the Apple Media Services Terms. We do not process payments and cannot issue refunds ourselves.

What BasePlate is not

BasePlate is a planning and reference tool. It is not a booking system, a contract, or a guarantee of anything.

In particular: sunset and golden-hour times are calculated estimates derived from the coordinates you supply, and alerts are local notifications subject to your device’s notification settings, battery state and Focus modes. Sync depends on a network you may not have at a venue. Do not rely on any of it as your only safeguard on a job that matters. Verify critical timings independently.

Other people’s information

Wedding timelines contain other people’s names and numbers. You are responsible for handling that information lawfully and appropriately, including any consent required in your jurisdiction.

Acceptable use

Do not reverse engineer or decompile the app, redistribute it, resell access to it, use it to store unlawful content, upload material you have no right to use, or attempt to reach data belonging to anyone else. We may suspend or close an account that does.

Availability

We aim to keep the service running but do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we ever shut the service down, we will give reasonable notice and a way to get your data out.

Liability

To the fullest extent the law allows, BasePlate is provided “as is”, and H3LX Labs LLC is not liable for indirect or consequential loss — including missed shots, missed moments, or lost business — arising from your use of it. Nothing here limits liability that cannot lawfully be limited. Where liability cannot be excluded, it is capped at what you paid us in the twelve months before the claim.

Ending it

You can stop at any time by deleting your account in Settings, which removes your data. We may end your licence if you materially breach these terms.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Changes

If these terms change in a way that matters, we will say so in the app before the change takes effect, and the date at the top will move.
